Welcome to the Bladework Games LLC website (the “Site”). By accessing or using this Site, you agree to comply with these Terms of Use (this “Agreement”). If you do not agree with all of the terms of this Agreement, you may not use the Site.

Bladework Games LLC, a Delaware limited liability company (“Bladework Games,” “we,” or “us”), provides this Site.

IMPORTANT: This Agreement contains a binding arbitration agreement and class action waiver in the “Dispute Resolution” section, which may require you to resolve disputes through arbitration instead of in court. Please read carefully.

1. Use of the Site

You may use this Site and all materials contained herein (collectively, “Materials”) only as permitted under this Agreement. Materials include images, logos, text, software, audiovisual works, promotional materials, and other content.

Limited License:
Bladework Games grants you a non-exclusive, non-transferable license to access and use this Site for personal purposes only. This license does not allow you to:

• Use the Site or Materials for commercial purposes;

• Distribute, publicly display, or otherwise exploit Materials without authorization;

• Modify, create derivative works, or reverse engineer any Materials;

• Download Materials (except for caching pages) unless expressly permitted;

• Use the Site or Materials in any manner other than intended
  
  

Unauthorized use terminates this license and may violate copyright, trademark, and other laws. Bladework Games may revoke this license at any time.

User Conduct:
Your use of the Site, including forums, must comply with Bladework Games’ Code of Conduct. Violations may result in termination of your access and other actions at our discretion.

2. Your Obligations

You agree not to:

• Use or transmit Materials on other websites or networks;

• Modify, reverse engineer, decompile, or create derivative works of Materials;

• Reproduce, distribute, license, sell, rent, or lease Materials;

• Remove or alter copyright or proprietary notices.
  
  

You also represent and warrant that you:

• Will comply with all applicable laws and regulations;

• Are not located in a country restricted by U.S. export laws;

• Will not upload materials containing viruses or harmful code, infringing third-party rights, or unlawful, defamatory, or objectionable content.
  
  

3. Bladework Games Ownership

All rights, title, and interest in the Site, Materials, and associated proprietary rights belong to Bladework Games or its licensors. No rights are transferred to you under this Agreement.

4. User Submissions

By posting or submitting content (“User Content”) to the Site:

• You grant Bladework Games a perpetual, irrevocable, worldwide, fully paid-up, non-exclusive, sublicensable license to use, reproduce, modify, distribute, and display the content in any format or media;

• You waive any moral rights to User Content;

• You represent that User Content does not infringe on third-party rights and is lawful and appropriate.
  
  

Bladework Games may remove any User Content at its discretion. Submissions do not create a contractual obligation to compensate you unless explicitly agreed.

5. Disclaimer of Warranties

This Site and Materials are provided “as is”. To the fullest extent permitted by law, Bladework Games disclaims all warranties, including:

• Merchantability or fitness for a particular purpose;

• Non-infringement;

• Availability, uninterrupted access, or error-free content.
  
  

Use is at your own risk.

6. Limitation of Liability and Indemnity

To the extent permitted by law, Bladework Games is not liable for any damages arising from your use of the Site, including indirect or consequential damages.

You agree to indemnify and defend Bladework Games and its affiliates from claims arising out of your use of the Site.

7. Governing Law; Venue for Non-Arbitrable Disputes

This Agreement is governed by Delaware law, U.S.A. For claims not subject to arbitration or small claims court, the exclusive jurisdiction is the state and federal courts in Orange County, California.

8. Dispute Resolution

Binding Arbitration and Class Action Waiver:

• Attempt to resolve disputes informally for 60 days.

• If unresolved, disputes will be resolved via binding individual arbitration under the Federal Arbitration Act and AAA Consumer Arbitration Rules (www.adr.org).

• Class actions, combined proceedings, or representative actions are prohibited.
  
  

Notice of Dispute:
Submit written notice to legal@bladeworkgames.com. Include your name, email, address, and details of the dispute.

Opt-Out:
You may opt out of arbitration within 30 days of first accessing the Site by emailing legal@bladeworkgames.com.

9. Miscellaneous

• No failure by Bladework Games to enforce rights constitutes a waiver.

• If any provision is unenforceable, it will be amended or severed without affecting remaining provisions.

• This Agreement constitutes the entire agreement between you and Bladework Games. We may update it periodically, with updates applying prospectively.
